These Terms of Service ("Terms") govern your use of ShameKitchen, a personal food accountability service operated by 814 Solutions ("ShameKitchen", "we", "our", "us"). By using ShameKitchen, you agree to these Terms.

What ShameKitchen is

ShameKitchen is a personal food accountability agent delivered through WhatsApp. You send us photographs and descriptions of your meals; we respond with personalised feedback, track patterns, open and close cases tied to your stated goals, and send you check-ins and verdicts.

ShameKitchen is delivered through automated systems including AI models, with human oversight of safety and quality. We may add, change, or remove features over time.

What ShameKitchen is not

ShameKitchen is not:

• A medical service, nutritional service, dietetic service, or mental health service
• A diagnostic tool of any kind
• A substitute for professional advice from a doctor, dietitian, psychologist, psychiatrist, or other qualified professional
• A weight-loss programme or body-modification programme

ShameKitchen is an accountability and behavioural-prompt service intended for adults who want help building food-related habits aligned with their own stated goals. Always listen to your body. If you are struggling with food, eating, body image, or mental health, please speak to a qualified healthcare professional.

Eligibility

You may use ShameKitchen only if all of the following are true:

• You are 18 years of age or older
• You have the legal capacity to enter into a binding contract under the law of your country
• You are not barred from using ShameKitchen under applicable law
• You are not on a sanctions list maintained by a recognised authority

By using ShameKitchen, you represent and warrant that all of the above are true. If you are using ShameKitchen on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Your account

Your WhatsApp phone number is your unique account identifier. You are responsible for the security of your phone and your WhatsApp account. We treat any message coming from your number as coming from you.

You agree to:

• Provide accurate information when we ask for it
• Notify us promptly at support@shame.kitchen if you believe your account has been used without your authorisation
• Use ShameKitchen only for yourself, not for others, unless we expressly permit it

You may close your account at any time by sending the message DELETE MY DATA to our WhatsApp number, following the two-step confirmation process.

Acceptable use

When you use ShameKitchen, you agree not to:

• Use the service for any purpose other than personal food accountability
• Send images that are not food or that are explicit, graphic, or illegal
• Send content depicting another person without their consent
• Attempt to manipulate, jailbreak, override, or otherwise interfere with our AI models or system behaviour
• Use automated means (scripts, bots, scrapers) to interact with the service
• Resell, sublicense, or commercially exploit the service or its output
• Use the service to harass, threaten, or harm any person, including yourself
• Use the service in any way that violates applicable law

We may suspend or terminate your access if we reasonably believe you have breached this section.

Free trial, subscriptions, and pricing

Free trial

New users receive a 7-day free trial with access to features described at signup. The trial ends automatically on day 7. We will notify you before it ends. A payment card is not required to start the trial.

Free tier after trial

After the trial, you may continue at a free tier with limited features (currently 1 roast per day, with safety features always available). Free tier limits may change. The Panic Button (SOS) and access to crisis resources will always remain free of charge.

Paid subscriptions

We currently offer:

• Monthly subscription
• Annual subscription
• Lifetime access (limited quantity)

Current prices are shown on our website (shame.kitchen). All prices include applicable taxes unless stated otherwise.

Auto-renewal

Monthly and annual subscriptions renew automatically at the then-current price until cancelled. You will be charged on each renewal date through your selected payment method.

Cancellation

You may cancel auto-renewal at any time. Cancellation takes effect at the end of the current billing period; you keep access to paid features until then. To cancel, message us at support@shame.kitchen with your account phone number. We will confirm cancellation within 3 business days.

Refunds

• Monthly subscriptions: non-refundable except where required by law
• Annual subscriptions: refundable on a pro-rata basis within 14 days of the renewal charge if you have used the service for fewer than 30 days in that billing period; otherwise non-refundable except where required by law
• Lifetime access: non-refundable except where required by law
• Trial upgrade refunds: if you upgrade during your trial and cancel within 24 hours of upgrade, full refund on request

Refund requests go to support@shame.kitchen.

Payment processors

INR payments are processed by Razorpay. Other currencies, if and when supported, will be processed by our then-current international payment processor. By subscribing, you agree to the terms of the payment processor in addition to these Terms.

Price changes

We may change prices for new subscribers at any time. For existing subscribers, we will give at least 30 days' notice before a price change applies to your renewals.

Your content and our content

Your content

You retain ownership of the photographs, text, voice notes, and other content you send to ShameKitchen ("Your Content").

By sending Your Content to us, you grant ShameKitchen a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, analyse, and use Your Content for the purpose of providing and improving the service to you. This licence ends when we delete the content under our retention schedule or at your request, subject to backups and legal retention requirements.

You represent that:

• You have the right to share Your Content with us
• Your Content does not infringe any third-party rights
• Your Content complies with Section 4 (Acceptable use)

Our content

The responses, roasts, cases, verdicts, rank titles, and other content generated by ShameKitchen ("Our Content") are generated automatically and provided to you for your personal, non-commercial use.

You may share screenshots of Our Content on social media if and as you choose, including with the #CrimesAgainstNutrition hashtag, provided you do not modify Our Content in a way that misrepresents what we said.

You may not:

• Use Our Content to train a competing AI model
• Resell, sublicense, or commercially distribute Our Content
• Strip our branding from publicly shared verdict cards

ShameKitchen brand and software

The ShameKitchen name, logo, website, software, system prompts, and all related intellectual property are owned by 814 Solutions. These Terms grant you no licence to use our brand or software beyond using the service as intended.

Safety and the Panic Button

ShameKitchen is designed with safety features that override roast and accountability behaviour when distress signals are detected. This includes the Panic Button (SOS) which surfaces country-appropriate crisis resources and switches the service to a supportive mode.

ShameKitchen is not a crisis service. If you are in immediate danger or having thoughts of self-harm, please contact your local emergency services or one of the helplines surfaced by the Panic Button.

AI and automated content

ShameKitchen's responses are generated by AI models. AI output can be wrong, unexpected, or sound confident while being inaccurate.

You agree that:

• You will not rely on ShameKitchen for medical, nutritional, mental health, legal, or other professional advice
• You understand that roasts are intentional behavioural prompts, not statements of fact
• You will use your own judgment about what is appropriate for your body and health

We do not warrant that AI output will be accurate, complete, suitable for your purposes, or free of error.

WhatsApp and third-party services

ShameKitchen is delivered through WhatsApp, a service operated by Meta Platforms, Inc. Your use of WhatsApp is governed by WhatsApp's own terms and privacy policy.

Our service depends on third-party providers (listed in our Privacy Policy). If those providers experience outages, our service may be unavailable. We are not responsible for the actions or outages of third-party providers, but we will use reasonable efforts to restore service.

Availability

We aim to keep ShameKitchen available, but we do not guarantee uninterrupted service. We may suspend or restrict the service for maintenance, upgrades, safety reasons, legal reasons, or for any reason in our reasonable discretion. We will give notice where practical.

Daily limits, rate limits, and feature availability may change. The current limits applicable to your tier are described on our website or in onboarding.

Termination

You may stop using ShameKitchen at any time. To delete your data, send DELETE MY DATA to our WhatsApp number.

We may suspend or terminate your access:

• Immediately and without notice if you breach Section 4 (Acceptable use), commit fraud, or pose a safety risk to yourself or others
• Immediately if required by law or by a regulator
• With reasonable notice for any other reason, including discontinuing the service

If we terminate your paid subscription without cause, we will refund the unused portion on a pro-rata basis. If we terminate for breach, no refund is owed.

Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, liability, indemnity, governing law, and dispute resolution) will survive.

Disclaimers

To the maximum extent permitted by law:

ShameKitchen is provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the service will meet your requirements, be uninterrupted, secure, or error-free.

No professional advice. Nothing in ShameKitchen constitutes medical, nutritional, mental health, psychological, legal, or financial advice. Always consult qualified professionals for matters within their expertise.

No outcome guarantee. We do not guarantee that using ShameKitchen will result in any particular outcome, including any change in your eating behaviour, habits, weight, or wellbeing.

Some jurisdictions do not allow the exclusion of certain warranties. To the extent we cannot exclude a warranty under applicable law, our liability is limited as set out in Section 13.

Limitation of liability

To the maximum extent permitted by law:

• ShameKitchen, 814 Solutions, and their respective officers, employees, agents, and contractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, business opportunities, or goodwill, arising out of or in connection with your use of the service.
• Our total cumulative liability to you for all claims arising out of or relating to ShameKitchen will not exceed the greater of (a) the amount you paid us for the service in the 12 months immediately preceding the event giving rise to the claim, or (b) ₹2,000 (Indian rupees two thousand) or its equivalent in your local currency.

These limits apply even if a remedy fails of its essential purpose.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud, gross negligence, or wilful misconduct.

Governing law and dispute resolution

Governing law

These Terms and any dispute arising out of or in connection with them are governed by the laws of India, without regard to conflict of laws principles.

Mandatory binding arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the service ("Dispute"), other than disputes carved out below, will be resolved by binding arbitration, not in court.

• For users resident in India: Arbitration will be seated in Bangalore, Karnataka, India, conducted in English by a sole arbitrator, under the Arbitration and Conciliation Act, 1996. The arbitration will be administered by a recognised Indian arbitral institution if the parties agree, or otherwise ad hoc.
• For users resident outside India: Arbitration will be seated in Singapore, conducted in English by a sole arbitrator, under the Singapore International Arbitration Centre (SIAC) Rules then in force.

The arbitrator's award is final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver

You and ShameKitchen agree that any Dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims by or against more than one person and may not preside over any form of representative or class proceeding.

If a court of competent jurisdiction finds this class action waiver unenforceable as to a particular claim or remedy, then that claim or remedy (and only that claim or remedy) will be severed and brought in court, and the remainder of the arbitration clause will continue to apply.

Injunctive relief carve-out

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to:

• Stop unauthorised use or infringement of intellectual property rights
• Stop a breach of confidentiality obligations
• Address a safety risk requiring immediate action

Seeking such relief is not a waiver of the right to arbitrate other Disputes.

Small claims

You may bring an individual claim in a small claims court of competent jurisdiction in your country of residence instead of arbitration, provided the claim qualifies and remains in that court.

Time limit

Any claim must be filed within one year of the event giving rise to the claim, unless a longer period is required by law.

Indemnity

You agree to indemnify and hold harmless ShameKitchen, 814 Solutions, and their respective officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your breach of these Terms
• Your misuse of the service
• Your Content
• Your violation of any law or the rights of any third party

We will notify you of any claim and may, at our option, assume control of its defence with counsel of our choice. You will cooperate reasonably with our defence.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you through WhatsApp or by updating the "Last Updated" date at the top of this page. Continued use of ShameKitchen after a material update constitutes acceptance of the updated Terms.

If you do not agree with an update, your remedy is to stop using the service and request deletion of your account.

General

Entire agreement. These Terms, together with the Privacy Policy and any feature-specific terms we present to you, constitute the entire agreement between you and ShameKitchen regarding the service.

Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.

No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of business assets, on reasonable notice.

Force majeure. We are not liable for failure to perform due to events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, internet outages, telecommunications failures, government action, pandemic, or natural disaster.

No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.

Language. These Terms are in English. Any translation we provide is for convenience only; the English version controls in case of conflict.
